Aegean Region Refrigeration Industry and Business Association (ESSIAD) was founded by the leading businessmen of the refrigeration industry in 1990. The main purpose of the Association is to keep the rights and the legal ethics of the people and the companies playing role in the HVAC-R sector, to enhance their professional development, to support their market improvement plans and besides to deliver the high quality products to the end-user.

Main projects of ESSIAD

Increasing Export Capacity of Industrial Ventilation, Air Conditioning and Refrigeration (HVAC-R) Cluster Project (COMPLETED)

Project has been approved within the scope of the International Competitiveness Improvement Notification (UR-GE) of T.R. Ministry of Economy. ESSIAD, playing the role of the coordination organization, firstly organized a field analysis to define the needs of the cluster members. It is aimed to increase the export and competitiveness of the cluster members through trainings, consultancies, abroad business trips, visits, preliminary delegation organizations, held in accordance with the results of the field analysis. Through this Notification, companies operating in the same sector, find common solutions to common problems and create a regional power in the international arena by acting together.

ESSIAD, the first cluster of the sector in operation, which is situated in the heart of the region where numerous Turkish HVAC-R companies are located, enables its members to establish competitive advantages by emphasizing innovation and quality factors in the international arena through the development of their commercial and technical capacities. The technical and commercial training and consultancy activities carried out within UR-GE project, aims the development of the technical capacity of the companies, ensuring the penetration into the new markets and managing the common infrastructure.

ESSIAD Continuous Training Center (ESEM)

ESSIAD Continuous Training Center organizes technical, corporate and personal development training programs, seminars in order to create awareness in the sector.

ESSİAD School to Profession Project

School to Profession project of ESSIAD aims to raise awareness of the vocational educated students about HVAC-R industry. Accordingly, cluster members share information regarding the sector, setting up career goals and related qualified professionals inform students about resume writing. Factory and technical visits are part of this project. School to Profession project has been running since 2012 and in 2017, it was submitted to T.R. Ministry of Interior Izmir General Directorate of Civil Society Relations as a project and financed for a period of 1 year.

Moreover ESSIAD took part in project partners of European Union Project called Adding Value to the Future, coordinated by Izmir Development Agency with Associazione Tecnici del Freddo (ATF / Italian Refrigeration Association) and LAMORO Development Agency. Within the scope of the project, thanks to the cooperation of representing Italy Piedmont region and EHIS cluster, ATF and ESSİAD and Development Agencies of the relevant regions LAMORO and İZKA; value chain analysis of the Industrial Ventilation Air Conditioning and Refrigeration sector was carried out for both regions. A conference called “Strengthening HVAC-R in Europe: Building the Future Together” was held at 21-22 April 2017, with the participation of sectoral civil society representatives and public authorities.

Today, Aegean Region Refrigeration Industry and Business Association (ESSİAD), as being one of the most powerful organizations in the sector, with its registered members, is proud of achieving its goals and setting new goals as they reached.

INFORMATION NOTICE ON THE PROCESSING OF PERSONAL DATA

As The Aegean Region Refrigeration Industry and Business Association (ESSİAD), we attach great importance to the protection of your personal data. In this regard, in our capacity as the data controller pursuant to the Law No. 6698 on the Protection of Personal Data (“KVKK”), we process your personal data in compliance with the KVKK, within the purposes and limits set out below, and exercise the utmost care in implementing the necessary administrative and technical measures required for their protection.

Accordingly, through this Information Notice on the Processing of Personal Data, we would like to inform our members, the representatives of our corporate members, and the natural and legal persons who, although not members of the Association, submit their personal data within the scope of our projects, about our personal data processing activities and your rights under the KVKK.

Personal Data We Process

Within the scope of the applicable legislation and the Association’s Articles of Association, we process the following categories of your personal data:

1. Identity Information

Name, surname, Turkish Republic Identification Number, and identity document information.

2. Contact Information

Your contact address, telephone number, e-mail address, and, where applicable, the mobile phone number, fax number, or any other communication details that you have indicated as your preferred means of communication with the Association.

3. Employment and Educational Information

Information voluntarily provided by you in the membership application form, including, but not limited to, the name of your current employer, your position within that organization, the name of your most recent employer, and the last educational institution from which you graduated.

4. Special Categories of Personal Data

Although the Association does not directly intend to process such data, your identity documents and photographs submitted to the Association may indirectly reveal special categories of personal data, such as your religion, philosophical beliefs, political opinions, and health information (for example, information inferred from clothing, medical devices, or prostheses visible in photographs). In addition, the names of the associations of which you are a member, if voluntarily disclosed in the membership application form, may also be processed.

For the purposes of this Information Notice, the above-mentioned data shall, to the extent that they relate to natural persons applying for projects, legal entities and their representatives, individual members, and the natural person representatives of our corporate members, constitute personal data within the meaning of the KVKK and shall hereinafter be collectively referred to as “Personal Data.”

Method of Collection and Legal Basis for Processing Your Personal Data

Your Personal Data are collected and processed verbally, in writing, or electronically through the membership application form submitted either in hard copy or via the Association’s website at www.essiad.org.tr, through documents submitted physically or electronically in connection with membership in the Association pursuant to the Association’s Articles of Association, and through information provided to the Association’s authorized representatives during various communications with the Association (such as communications by telephone or e-mail).

Within this scope, your Personal Data are processed for the purposes of carrying out the activities specified in the Association’s Articles of Association and within its fields of activity; organizing, managing, and conducting events and related processes for members or their representatives, including General Assembly meetings, working group meetings, summits, agenda meetings, and other member meetings; ensuring communication between the Association and its members regarding membership rights and obligations and fulfilling the related rights and obligations; carrying out internal reporting activities; submitting the required information and documents to administrative authorities, public institutions, and courts upon request; maintaining the books and records required to be kept by the Association under the applicable legislation; and fulfilling the obligations arising from the Law on Associations, the Regulation on Associations, and other applicable legislation.

Accordingly, your Personal Data are processed pursuant to Article 5/2(c) of the Law on the Protection of Personal Data (KVKK), where processing is necessary for the Association, acting as the data controller, to comply with its legal obligations.

Furthermore, your Personal Data are processed pursuant to Article 5/2(f) of the KVKK where processing is necessary for the legitimate interests of the Association, provided that such processing does not prejudice the fundamental rights and freedoms of our members (or the natural person representatives of our corporate members). These legitimate interests include maintaining communication with members, promoting the Association and informing members about its activities and events, determining and implementing the Association’s activities and services, carrying out its service policies, strengthening internal communication and cooperation, informing members about Association activities, ensuring the security and supervision of all Association facilities, and creating copies or backups to prevent data loss.

In addition, pursuant to Article 5/2(e) of the KVKK, your Personal Data are processed where such processing is necessary for the establishment, exercise, or protection of a legal right, including the proper implementation of Association projects and the conduct of legal proceedings relating to members.

Furthermore, within the scope of the Association’s projects, the personal data of our members and project applicants may be shared with one another solely for the purpose of facilitating communication between them.

In processing your Personal Data, the Association acts in accordance with the data processing principles and obligations set forth under the applicable legislation, particularly the Constitution of the Republic of Türkiye, the international treaties to which Türkiye is a party, the Law No. 6698 on the Protection of Personal Data (KVKK), the relevant secondary legislation, and the guidelines and principle decisions issued by the Personal Data Protection Authority.

Purposes of Processing Your Personal Data

Your Personal Data are processed for the following purposes:

  1. Carrying out the activities of the Association in line with the objectives and fields of activity set out in the Association’s Articles of Association.
  2. Organizing, managing, and conducting events and related processes for Association members or their representatives, including General Assembly meetings, working group meetings, committee meetings, summits, agenda meetings, and other member meetings.
  3. Ensuring communication between the Association and its members regarding membership rights and obligations, and fulfilling the related rights and obligations.
  4. Promoting the Association and providing information about its activities and events.
  5. Determining and implementing the Association’s activities and services, and carrying out its service policies.
  6. Implementing and managing the Association’s projects.
  7. Strengthening internal communication and cooperation within the Association.
  8. Carrying out the Association’s internal reporting activities.
  9. Informing members about the Association’s activities.
  10. Ensuring the security and supervision of all facilities belonging to the Association.
  11. Providing the necessary information and documents to administrative authorities, public institutions, and courts upon their request.
  12. Maintaining the books and records that the Association is required to keep under the applicable legislation.
  13. Fulfilling the obligations arising under the Law on Associations, the Regulation on Associations, and other applicable legislation.
  14. Conducting legal proceedings relating to members.
  15. Creating copies and backups to prevent data loss.

Transfer of Your Personal Data Within Türkiye or Abroad and the Purposes of Such Transfer

The Association may transfer your Personal Data to the persons and organizations specified below, in accordance with the fundamental principles stipulated under the Law No. 6698 on the Protection of Personal Data (KVKK) and under the following circumstances:

1. Where required under the Law on Associations, the Regulation on Associations, or any other applicable legislation in force during the period in which your personal data are processed, or where such disclosure is necessary for the fulfilment of a legal obligation, your Personal Data may be shared, solely to the extent necessary, with the relevant public authorities and institutions to enable the Association to comply with its legal obligations.

2. If, in addition to your membership or your capacity as the natural person representative of a corporate member, you serve in any governing body of the Association, your Identity Information, Contact Information, and professional information may be shared with the Provincial Directorate of Associations and other relevant public authorities, where such transfer is necessary for the Association, as the data controller, to fulfil its legal obligations arising under the Law on Associations and the applicable secondary legislation.

3. In connection with projects carried out by the Association, your Personal Data may be shared with public or private institutions and organizations for the purposes of planning and delivering the relevant services, improving those services, fulfilling obligations arising from their nature, and planning activities necessary to customize, recommend, and promote such services by taking into account users’ preferences, usage habits, and needs.

4. For the purpose of organizing various activities and services of the Association, such as General Assembly meetings, working group meetings, summits, agenda meetings, and other member meetings, the Association may from time to time engage external event management companies. In order to organize such events and provide participants with event-related materials, including identification badges, the names and surnames of the participants may be shared with the event management company authorized by the Association for the relevant event and acting as a data processor solely for that specific purpose. Such transfer shall be made on the basis of the Association’s legitimate interests as the data controller, provided that it does not prejudice your fundamental rights and freedoms.

5. Although no specific transfer of Personal Data is made to such service providers, the Association engages external information technology service providers for the provision of IT services. Based on the legal ground that processing is necessary for the legitimate interests of the Association, provided that it does not prejudice the fundamental rights and freedoms of our members (or the natural person representatives of our corporate members), these service providers may, from time to time and solely for the purpose of providing technical support, access the servers and software used by the Association and, indirectly, the data stored therein. However, such service providers do not transfer the Personal Data to their own systems, nor do they process or retain such data on their own behalf.

6. In the event of any dispute relating to a member’s rights or obligations or the member’s relationship with the Association, your Personal Data may be shared, solely to the extent necessary for the relevant dispute, with the Association’s attorneys, legal advisors, competent judicial authorities, and enforcement authorities where such processing is necessary for the establishment, exercise, or protection of the Association’s legal rights.

7. Where necessary for the Association to fulfil the data processing purposes described above and to carry out its activities in accordance with its Articles of Association, your Personal Data may be shared, only to the extent necessary, with domestic third parties from whom the Association receives services, support, or consultancy, such as consultants, certified public accountants, and auditors, where such sharing is necessary for the establishment, exercise, or protection of the Association’s legal rights or is based on the Association’s legitimate interests, provided that it does not prejudice your fundamental rights and freedoms.

8. In addition to the foregoing, where required for compliance with any legal obligation in force at the time of the relevant transaction or request, or where requested by competent public authorities, your Personal Data may be shared with the relevant public institutions, organizations, or judicial authorities to the extent necessary for the fulfilment of such legal obligations.

Your Rights as a Data Subject Under the KVKK

As a data subject under the Law No. 6698 on the Protection of Personal Data (KVKK) and the applicable legislation, you have the right to:

  1. Learn whether your Personal Data are being processed;
  2. Request information if your Personal Data have been processed;
  3. Learn the purpose of the processing of your Personal Data and whether they are used in accordance with that purpose;
  4. Learn the third parties to whom your Personal Data have been transferred, whether within Türkiye or abroad;
  5. Request the correction of your Personal Data if they are incomplete or inaccurate;
  6. Request the deletion or destruction of your Personal Data under the conditions stipulated in the KVKK;
  7. Request that the third parties to whom your Personal Data have been transferred be notified of any correction, deletion, or destruction carried out pursuant to Items 5 and 6 above;
  8. Object to any result that is detrimental to you arising from the analysis of your Personal Data exclusively through automated systems; and
  9. Request compensation for damages incurred as a result of the unlawful processing of your Personal Data.

How to Exercise Your Rights

  • Pursuant to the provisions of the Law No. 6698 on the Protection of Personal Data (KVKK) and the Communiqué on the Procedures and Principles of Application to the Data Controller, you may submit your request to exercise the rights specified above, together with documents verifying your identity, by one of the following methods:
  • by delivering a written application bearing your handwritten signature in person to The Aegean Region Refrigeration Industry and Business Association (ESSİAD), Anadolu Caddesi No: 40, Tepekule Business Center, Floor: 2, No: 208, Bayraklı, İzmir, Türkiye;
  • by sending your application via Registered Electronic Mail (KEP) to essiad@essiad.org.tr; or
  • by submitting your application signed with a secure electronic signature or a mobile signature in accordance with the applicable legislation.

Your request will be evaluated and concluded in accordance with the provisions of the KVKK and the relevant legislation.
